Application for authorisation or notification of the supply/provision of hazardous substances and mixtures in accordance with ChemVerbotsV as well as change notifications in the event of a change of competent person
The Chemicals Prohibition Ordinance (ChemVerbotsV) contains in particular requirements for the commercial placing on the market, supply or provision of certain hazardous substances and mixtures. This includes the need for authorisation or notification of such activities.
A licence from the competent authority must be obtained before certain hazardous substances or mixtures are dispensed or made available (Section 6 (1) ChemVerbotsV). Pharmacies and the exclusive supply to the following group of recipients are exempt from this requirement.
Easier requirements apply for supply to resellers, professional users and public research, testing and teaching institutions. Instead of a licence, the competent authority must be notified in writing of the first commercial supply or provision of the substances or mixtures before this activity commences (Section 7 (1) ChemVerbotsV).
Annex 2 of the ChemVerbotsV specifies which substances or mixtures are affected by these requirements.
Competent persons who fulfil the requirements listed below are required for both the permit and the notification. The competent authority must be notified immediately in writing of any change of qualified person(s) (Section 6 (3) and Section 7 (2) ChemVerbotsV).

Prerequisite
A prerequisite for the granting of a licence or for the processing of a notification is that at least one person in the company is named,
- who has demonstrated sufficient expertise in accordance with ChemVerbotsV,
- has the necessary reliability and
- is at least 18 years old.
Companies are granted a permit if they employ persons who fulfil these requirements in every establishment where substances and mixtures covered by Annex 2 ChemVerbotsV are offered.
Procedure
Please note that the procedure must be carried out in the order stated:
- Complete the form below and send it to marktueberwachung@rpt.bwl.de or by post to Department 114 of the Regional Council of Tübingen.
- We will contact you and inform you of the file number.
- An official certificate of good conduct (document type O) of the competent person(s) is required to process notifications, authorisations or change notifications of the competent person:
- The certificate of good conduct must be applied for by the designated authorised person(s) at the registration office responsible for them.
- When applying for the certificate of good conduct, the file number provided must be stated.
- Please indicate the Regierungspräsidium Tübingen, Referat 114 Chemikaliensicherheit, Konrad-Adenauer-Straße 20, 72072 Tübingen as the target authority.
- Further processing can only take place once the official certificate of good conduct is available.
- The certificate of good conduct must be applied for by the designated authorised person(s) at the registration office responsible for them.
- The Tübingen Regional Council will inform you of the outcome of the procedure.
Deadlines
Permit: You must apply for a permit before commencing the activity and may only commence the activity after the permit has been granted.
Notification: You must submit the notification before commencing the activity.
Notificationof change of qualified person(s): You must notify the change as soon as you are aware of it.

Costs
Fees are charged for the issue of a licence or the processing of a notification in accordance with the State Fees Act.
Processing time
As a rule, processing takes one to three weeks after receipt of all documents and evidence.
